Comparative Research

In the framework of the XXII General Congress of the International Academy of Comparative Law (Berlin 2026) , a session will be devoted to the topic The Aspiration of Self-Sufficiency of International Contracts and the Challenge of Their Uniform Interpretation in the Resolution of Commercial Disputes.

Professor Marco Torsello (University of Verona) was appointed as General Reporter .

​

Pursuant to the Academy's tradition, professor Torsello prepared a questionnaire to be compiled by the national and special reporters. The national and special reports will be the basis for his General Report . The questionnaire is meant to provide, inter alia, a basis for a comparative study of domestic rules on contractual interpretation and of the impact thereon of international contract practice.
 

As part of the questionnaire, professor Torsello has incorporated the cases in the questionnaire that was distributed to international arbitrators in the frame of Cordero-Moss' project on contract interpretation in arbitration.

Professor Torsello's questionnaire requests individual reporters to indicate how national judges in their respective jurisdictions most likely would solve the cases in Cordero-Moss' questionnaire, applying their domestic law.

​

The results of professor Torsello's questionnaire will be used as a benchmark for the answers given by the arbitrators in the project on contract interpretation in arbitration.
